Welcome to Draviontale. These Terms of Use govern your access to and use of our online masterclass platform, including all content, features, and services offered through Draviontale.sbs (the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms of Use.

1. Acceptance of Terms

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must not use the Platform.

2. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms of Use.

3. Account Registration

To access certain features of the Platform, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Keep your password secure and confidential
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms of Use.

4. Platform Access and Use

4.1 License Grant

Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial educational purposes.

4.2 Restrictions

You agree not to:

Copy, modify, distribute, sell, or lease any part of the Platform or its content
Reverse engineer, decompile, or attempt to extract source code from the Platform
Remove, obscure, or alter any proprietary notices on the Platform
Use the Platform for any illegal or unauthorized purpose
Transmit any viruses, malware, or harmful code
Interfere with or disrupt the Platform or servers connected to it
Attempt to gain unauthorized access to any portion of the Platform
Use automated systems or software to extract data from the Platform
Share your account credentials with others
Download or record masterclass content without explicit permission

5. Masterclass Content and Intellectual Property

5.1 Ownership

All content on the Platform, including but not limited to masterclasses, videos, text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Draviontale or its content suppliers and is protected by intellectual property laws.

5.2 Content Usage

Masterclass content is provided solely for your personal educational use. You may not:

Reproduce, distribute, or publicly display any content from the Platform
Create derivative works based on Platform content
Use content for commercial purposes without written authorization
Record, screenshot, or capture content through any means
Share access to masterclasses with individuals who have not purchased access

5.3 User-Generated Content

If you submit comments, reviews, feedback, or other content to the Platform, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, and display such content. You represent that you own or have the necessary rights to grant this license.

6. Payment and Subscriptions

6.1 Pricing

Prices for masterclasses and subscriptions are displayed on the Platform and may be changed at any time. All prices are in the currency indicated on the Platform.

6.2 Payment Processing

Payment processing is handled through third-party payment processors. You agree to provide accurate payment information and authorize us to charge your designated payment method.

6.3 Subscriptions

If you purchase a subscription:

Your subscription will automatically renew at the end of each billing period
You will be charged the then-current subscription rate
You may cancel your subscription at any time through your account settings
Cancellation takes effect at the end of the current billing period
No refunds will be provided for partial subscription periods

6.4 Refund Policy

We offer refunds within 14 days of purchase for individual masterclasses if you have viewed less than 20% of the content. Refund requests must be submitted through our support channels. We reserve the right to refuse refunds in cases of abuse.

7. User Conduct

You agree to use the Platform in a respectful and lawful manner. You will not:

Harass, threaten, or harm other users or instructors
Post or transmit offensive, defamatory, or inappropriate content
Impersonate any person or entity
Engage in any form of spam or unsolicited advertising
Violate any applicable laws or regulations
Infringe upon the rights of others

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. By using the Platform, you consent to our data practices as described in the Privacy Policy.

9. Third-Party Links and Services

The Platform may contain links to third-party websites or services that are not owned or controlled by Draviontale. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. You access such third-party resources at your own risk.

10. Disclaimers and Limitations of Liability

10.1 Platform Availability

The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, secure, or error-free. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice.

10.2 Content Accuracy

While we strive to provide accurate and high-quality educational content, we make no warranties regarding the accuracy, completeness, or reliability of any content on the Platform. Masterclass content represents the views and techniques of individual instructors and may not be suitable for all learners.

10.3 Limitation of Liability

To the maximum extent permitted by law, Draviontale and its affiliates, instructors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of data, loss of profits, or loss of educational opportunities.

10.4 Maximum Liability

Our total liability to you for all claims arising from or related to the Platform shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Draviontale, its officers, directors, employees, agents, and instructors from and against any claims, liabilities, damages, losses, costs, or expenses arising from your use of the Platform, your violation of these Terms of Use, or your violation of any rights of another party.

12. Intellectual Property Infringement

We respect the intellectual property rights of others. If you believe that content on the Platform infringes your copyright or other intellectual property rights, please contact us at help@Draviontale.sbs with the following information:

Description of the copyrighted work or intellectual property you claim has been infringed
Location of the infringing material on the Platform
Your contact information
A statement that you have a good faith belief that the use is not authorized
A statement that the information in your notice is accurate
Your physical or electronic signature

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at help@Draviontale.sbs or through your account settings. Termination does not entitle you to a refund of any fees already paid.

13.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without cause or notice, including if:

You violate these Terms of Use
You engage in fraudulent or illegal activities
Your account has been inactive for an extended period
We discontinue the Platform or specific services

13.3 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms of Use that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Modifications to Terms

We reserve the right to modify these Terms of Use at any time. We will notify you of material changes by posting the updated terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such modifications constitutes your acceptance of the updated terms. We encourage you to review these Terms of Use periodically.

15. Dispute Resolution

15.1 Informal Resolution

If you have any dispute with us, you agree to first contact us at help@Draviontale.sbs and attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations.

15.2 Arbitration

If we cannot resolve the dispute informally, any dispute arising from or relating to these Terms of Use or the Platform shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.

15.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

16. General Provisions

16.1 Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Draviontale regarding the Platform and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms of Use will not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms of Use or your account without our prior written consent. We may assign these Terms of Use without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of nature, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, or communications failures.

16.6 Language

These Terms of Use are provided in English. Any translations are provided for convenience only. In the event of any conflict between the English version and any translation, the English version shall prevail.
